1. Acceptance of Terms By accessing, browsing, or making a purchase from ATX Dispensary LLC (“Company”, “we”, “us”, or “our”) via www.atxdispensaryllc.com (the “Site”), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

2. Age Requirement (Strict 21+ Policy) You must be at least twenty-one (21) years of age to access this Site or purchase products. By agreeing to these Terms, you warrant that you are at least 21 years old. We reserve the right to request government-issued identification for age verification at any time. Falsifying your age to purchase products from this Site is illegal and may be reported to authorities.
3. Legal Compliance & Product Disclaimer
Federal Compliance: All products sold on this Site contain less than 0.3% Delta-9 tetrahydrocannabinol (THC) on a dry weight basis and are fully compliant with the Agriculture Improvement Act of 2018 (the “2018 Farm Bill”).

4. Shipping & Restrictions We reserve the right to decline shipping to any state or territory where local laws conflict with the 2018 Farm Bill. It is the customer’s responsibility to know the laws of their specific jurisdiction.
Restricted Jurisdictions: We do not ship to Idaho, South Dakota, or any other jurisdiction where hemp-derived products are explicitly banned.
Risk of Loss: All items purchased from this Site are made pursuant to a shipment contract. The risk of loss and title for such items pass to you upon our delivery to the carrier.
5. REFUND POLICY: ALL SALES FINAL Due to the nature of the products we sell, all sales are final.
We do not accept returns or exchanges based on personal preference.
Damaged or Defective Items: In the rare event that you receive a damaged or defective product, or if an error was made in your order, you must notify us within 48 hours of delivery.
Contact for Claims: Please email support@atxdispensaryllc.com or call our support line at (737) 497-1499. You may be required to submit a photo of the damaged packaging and product.
Chargebacks: By making a purchase, you agree not to initiate a credit card chargeback without first attempting to resolve the issue directly with ATX Dispensary LLC. Unjustified chargebacks will be contested legally and may result in a permanent ban from our Site.
6. Limitation of Liability In no event shall ATX Dispensary LLC, its officers, directors, employees, or its web hosting provider (iFreshly Digital) be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of or in any way connected with the use of this Site or the misuse of our products.
7. Governing Law These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
